Invisalign customers can continue using 3Shape scanners for case submissions in select regions outside U.S., China, and Japan.

Yesterday, orthodontic company Align Technology (maker of Invisalign, intraoral scanners, and digital orthodontics and restorative dental software, settled a longstanding patent and antritrust lawsuit with digital dentistry firm 3Shape. The case began in November 2017. Litigation included patent infringement allegations and petitions to invalidate patents before the U.S. Patent Trial and Appeal Board by both companies. The settlement also resolves a 3Shape antitrust claim. After settlement, Invisalign customers can continue using 3Shape Trios 2 and 3 scanners for case submissions in select regions outside the U.S., China, and Japan. Further terms were confidential. “Align Technology is pleased to have resolved these disputes with 3Shape,” Julie Coletti, Align senior VP and chief legal and regulatory officer told the press. “We will continue our focus on innovation, including technologies such as the award-winning iTero Element 5D imaging system which aids in the detection and monitoring of interproximal caries lesions above the gingiva without using harmful radiation.1” Reference 1 Data on file at Align Technology
